WILL: This is the last Will and Testament of me William John Albert formally of London Street ffitzroy Square in the County of Middlesex but now residing at Dunkirk in the kingdom of ffrance and at present staying at No. 77 Aldermanbury in the City of London Esquire by me duly made and published this twenty second day of December in the year of our Lord one thousand eight hundred and thirty five as follows that is to say whereas under or by virtue of certain Indentures of lease and release and assignment bearing date the eleventh and twelfth days of September one thousand eight hundred and fifteen and a certain other Indenture or Declaration of trust of the same date as the said Indenture of release and assignment and each made between me the said William John Albert of the one part and Rachel Pereira widow Sir Manasseh Masseh Lopez baronet and Ralph ffranco Esquire of the other part I conveyed settled and assured my undivided Third part or share of and in certain ffreehold and leasehold premises situate and being in Thames Street in the several parishes of Saint Botolph Billingsgate and Saint Magnus London therein respectively particularly mentioned and described unto the said Rachel Pereira Sir Manasseh Masseh Lopez baronet and Ralph ffranco their heirs executors administrators and assigns upon Trust for me and my assigns for the term of my natural life and after my decease upon Trust by the means therein mentioned to raise the sum of Two thousand pounds with interest for the same from my decease until it should be raised at the rate of ffive pounds pre cent per annum together with the costs and expenses attending the raising thereof and to stand possessed of the said sum of Two thousand pounds and interest upon trust to invest the same in the public ffunds upon Government or real security at interest with power to alter and transpose the same as therein mentioned and subject thereto upon trust to pay the interest dividends or annual proceeds thereof unto Sarah my wife or her assigns during her life and after the decease of the survivor of us upon such trusts in favor or for the benefit of all and every or any one or more of my Children by my said wife then living or thereafter to be born or in favor or for the benefit of all or every one or any one or more of the lawful issue born in my lifetime of the said Children or any of them or both in favor or for the benefit of all and every one or any one or more of the said Children and also of any one or more of such issue as aforesaid in such parts and shares and proportions and subject to such conditions restrictions and limitations over to or in favor of any other or others of such children or issue aforesaid as I the said John William Albert at any time or times during my life by any Deed or Deeds writing or writings with or without power of revocation to be by me respectively sealed and delivered in the presence of and attested by two or more reliable witnesses or by my last Will or Codicil in writing to be by me signed and published in the presence of and attested by the like number of witnesses shall direct or appoint and in default of such direction or appointment In Trust as in therein mentioned and in which said Indenture or Declaration of Trust is contained a proviso that in case there shall be no child by me the said William John Albert by the said Sarah my Wife who being a son shall attain the age of twenty one years or being a daughter shall attain that age or marry then that the said sum of Two thousand pounds or the securities or ffunds in or upon which the same shall be invested or so much or such part thereof as shall not have become vested in or have been applied for the advancement of any such child or Children or Issue as aforesaid in pursuance or in exercise of the several powers or authorities therein contained shall remain and be subject to the trusts therein before declared in favor of my said Wife as aforesaid Upon Trust for me the said William John Albert my Executors administrators and assigns And Whereas it is my will and intention that the said sum of two thousand pounds and interest shall after the decease of my said wife go to and in favor and for the use and benefit of my only son Hugh Charles Albert his Executors Administrators and assigns and to and for no other Trust interest or purpose whatsoever but in as much as he at present lies under the misfortune of being imbecile in mind it is my will and intention that the said sum of two thousand pounds and interest shall be paid over to my ffriends Harriet Ogilvy of Dunkirk aforesaid Widow John Mills Probyn of Kennington in the County of Surrey Doctor of Phisick and Henry Carpenter of Aldermanbury in the City of London Gentleman and the survivors and survivor of them his or her executors or Administrators Upon such Trusts in favor of and for the sole benefit support and maintenance of my said son Hugh Charles Albert as hereinafter mentioned expressed an declared and for no other trust interest or purpose whatsoever and which said Harriet Ogilvy John Mills Probyn and Henry Carpenter I shall hereinafter appoint joint Guardians of my said son and Curators of his person Estate and Property Now therefore I the said William John Albert in pursuance and exercise of the power and authority to me given and in me vested in and by the said several recited Indentures of Lease and release and assignment and Declaration of Trust and of all and every other power and powers authority and authorities in me vested and enabling me in this behalf have directed and appointed and by this my last will by me duly signed and published in the presence of and to be attested by the three credible persons whose names are intended to be hereunto subscribed or hereon endorsed as witnesses attesting the due signing and publishing of the same by me the said William John Albert do direct and appoint that the said sum of Two thousand pounds and interest shall go and be paid and applied for the sole use and benefit of my said son Hugh Charles Albert his executors and administrators and for that purpose I do hereby for the reasons aforesaid direct and appoint that the said sum of Two thousand pounds shall be paid into the hands of the said Harriet Ogilvy John Mills Probyn and Henry Carpenter and the survivor and survivor of them his or her executors and administrators upon trust for him my said son Hugh Charles Albert his executors administrators and assigns in manner hereinafter mentioned that is to say In Trust to place the said sum of Two thousand pounds out at interest upon government o real securities as they in their discretion may see fit and apply pay and dispose of the interest dividends and annual proceeds thereof for the support and maintenance of my said son Hugh Charles Albert the full extent thereof so that he may have every comfort that the same will extend to provide for him but in such way and in such place and manner and under such restraint care and attention as they the said Harriet Ogilvy John Mills Probyn and Henry Carpenter the survivors and survivor of them as such Guardians as aforesaid to place my said son Hugh Charles Albert in any Asylum they he or she may deem best and most for his comfort and convenience and from and after the decease of my said son Hugh Charles Albert Then In Trust to apply pay and dispose of the said principal sum of Two thousand pounds and interest and all interest and dividends which may be due thereon to such person or persons and is such parts shares and proportions manner and form as he my said son Hugh Charles Albert shall by any Deed or Will which he shall be sufficiently recovered to be enabled to make and execute and not making and executing any such Deed or Will Then In Trust for his legal representatives in a due course of administration and to pay over the same or assign and transfer the Stocks ffunds and securities wherein the same shall be invested unto him her or they accordingly and as to my remaining Estate share and interest of and in the said ffreehold and Leasehold Warehouses and Premises so chargeable with the payment of the said sum of Two thousand Pounds as aforesaid and as to the said sum of Two thousand pounds in case the same shall devolve to me by the deaths of my said Children under the proviso aforesaid and as to all and singular other my real and personal Estate and Effects whatsoever and wheresoever and of what nature kind or sort soever after and subject to the payment of all and singular my just debts ffuneral and Testamentary charges and expenses I do hereby give devise and bequeath the same and every part thereof and all my Estate right title and interest term and terms of years benefit and advantage property claim and demand whatsoever of in and to the same and every part in thereof unto the said Harriet Ogilvy her heirs executors administrators and assigns to hold to her the said Harriet Ogilvy her heirs executors administrators and assigns for ever according to the several natures and tenures thereof my daughters being already provided for and I being under great pecuniary obligations to the said Harriet Ogilvy provided always and my will is that the trustees and executors of this my will having invested the said sum of Two thousand pounds in the public Stocks or ffunds of Great Britain or upon Government or real securities at interest may alter vary and transpose such securities and ffunds as often as to them shall seem proper until the same trust monies securities or ffunds shall become payable or transferable by virtue of the trusts and directions hereinbefore contained provided also and my mind and will further is that in case of the death either of them the said Harriet Ogilvy John Mills Probyn and Henry Carpenter the Trustees hereinbefore named and appointed I hereby will and direct that the survivors or survivor of them do and shall immediately after the death of either of them the said Trustees by Deed or writing under his or her hand and seal to be attested by two or more credible Witnesses nominate and appoint some other fit and proper person or persons to be a trustee or trustees in the place and stead of the trustee so dying which new trustee or trustees so to be nominated and appointed shall have the same power and authority in and touching the Trust premises and in the execution of the Trusts hereinbefore contained and the care and Guardianship of my said son as they the said Harriet Ogilvy John Mills Probyn and Henry Carpenter would have had or been entitled to under or by virtue of this my will or otherwise in case they had been living and I hereby declare and direct that the said Harriet Ogilvy John Mills Probyn and Henry Carpenter and each of them their and each of their executors or administrators shall not be charged or chargeable with or answerable or accountable for any money under or by virtue of the Trusts powers and authorities hereby in them respectively vested or imposed or any of them other than such only as they respectively shall actually receive nor with or for any loss that may happen of the said trust monies or any part thereof unless the same shall happen by their respective willful neglect or default and that neither of them shall be answerable or accountable for the others or other of them or for the acts deeds receipts disbursements neglects or defaults of the others or other of them and also that it shall and may be lawful to and for the said Harriet Ogilvy John Mills Probyn and Henry Carpenter and each of them by and out of the said Trust ffunds securities and premises in them vested as afore said or the interest dividends and produce thereof or that may come to their hands respectively to deduct retain to and reimburse themselves respectively shall or may bear pay suffer sustain or expend or be put unto or about the execution of the trusts hereby in them respectively reposed or by reason or means thereof or in relation thereto respectively and I do hereby nominate constitute and appoint the said Harriet Ogilvy John Mills Probyn and Henry Carpenter joint (Guardians of my said son and curatos of his person and property and) Executrix and Executors of this my Will and herby revoking and making void all former and other Wills Codicils to Wills and Testamentary dispositions by me at any time heretofore made I do so publish and declare this and this only to be my last Will and Testament In witness whereof I the said William John Albert the testator have to this my Will contained in five sheets of paper set my hand and seal that is to say my hand to the bottom of the four preceding sheets of paper and my hand and seal to this fifth and last sheet the day
